3. Application of these Terms
These Terms of Service apply to every offer made by the Seller and every Contract entered into between the Seller and the customer.
Before entering into a Contract, the customer has the opportunity to read these Terms on the Website.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force.
Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot be excluded, restricted or modified under the Australian Consumer Law or other applicable consumer protection legislation.
4. Offers and product information
The Seller endeavours to provide the most accurate descriptions of all products. However, due to screen settings, lighting, manufacturing processes or changes made by suppliers, there may be minor differences in colour, appearance or packaging.
Obvious errors, typing mistakes or unintentional omissions may occur in prices and product information published on the Website.
Product photos are intended to illustrate the products. Because screen settings differ, actual colours may vary slightly from those shown.
All offers are valid while stock lasts, unless expressly stated otherwise.
5. Formation of the Contract
A Contract is formed when the customer places an order and receives an order confirmation from the Seller.
The Seller reserves the right to refuse or cancel an order where there is a justified reason, including suspected fraud, an obviously incorrect price, product availability problems or incomplete payment.
If an order is cancelled after payment has been made, the customer will be refunded the amount paid for the undelivered or cancelled part of the order.
6. Prices and taxes
All prices on the Website are shown in Australian dollars (AUD) and include GST where applicable, unless applicable law provides otherwise.
Unless expressly stated otherwise, prices do not include any import duties, customs fees or similar charges that may apply to deliveries outside Australia.
7. Delivery areas
The Seller currently delivers to the areas shown on the Website and during checkout.
Whether delivery is available to a particular location is shown to the customer when the order is placed.
The Seller may expand or restrict its delivery areas.
8. Order processing and delivery
We usually process orders within 1 to 2 business days of payment confirmation.
Estimated delivery times stated on the Website or during checkout are a guide only, unless expressly stated otherwise.
The Seller is not liable for delays caused by carriers, customs authorities, public holidays, seasonal demand, weather conditions, force majeure or other circumstances beyond its reasonable control, unless applicable law provides otherwise.
If a product cannot be delivered or there is a significant delay, the Seller will make reasonable efforts to notify the customer and offer an appropriate solution.
9. Order tracking
Where tracking is available, the Seller will email the customer the information needed to track their parcel after dispatch.
The customer is responsible for providing a correct and complete delivery address.
If additional costs arise or delivery is not possible because of an incorrect or incomplete address provided by the customer, the customer may be required to pay the reasonable costs incurred, where the law allows.
10. Consumer guarantees under the Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
To make a claim, contact us at info@ateljevera.si with your order number and, if possible, photos of the problem.
11. Extended 30-day return period
In addition to your rights under the Australian Consumer Law, Vera & Rose Jewellery voluntarily offers a 30-day return period from the date the product is received, under the conditions set out below.
To be accepted under this voluntary period, the product must be unused, unworn, undamaged and preferably in its original packaging.
Before returning a product, the customer must contact info@ateljevera.si and provide their order number.
This voluntary 30-day return option does not limit the customer's rights under the Australian Consumer Law or any other statutory rights in any way.
12. Return costs
Unless applicable law provides otherwise, the direct costs of returning goods under the voluntary 30-day period are paid by the customer.
If a product is faulty, damaged or incorrectly delivered on receipt, the Seller will deal with the matter and provide a remedy in accordance with the Australian Consumer Law, including reimbursement of reasonable return costs where the consumer is entitled to them.
13. Refunds
After receiving and inspecting the returned product, the Seller will inform the customer of the next steps.
If a return is approved, the refund will be made to the original payment method. Refunds under the voluntary 30-day period are processed within 14 days of approval.
Original shipping costs are not refunded under the voluntary 30-day period, unless applicable law provides otherwise.
14. Governing law
These Terms are governed by the laws of [TO BE COMPLETED – state or territory], Australia, and the Australian Consumer Law applies to every Contract to the extent required by law.
